COMPLETE WRITTEN TERMS
What This Warranty Covers — and What It Does Not.
These written terms control the warranty. Keep your proposal, contract, invoices, approved design records, care instructions, and project photographs with your records.
1. Provider, project records, and meaning of coverage
“PrimeSlab” means PrimeSlab LLC. This is a limited warranty of PrimeSlab’s preparation and installation workmanship for the qualifying work identified in the project agreement. It is not an insurance policy, an unlimited maintenance plan, or a promise that every change in appearance is a defect. The project agreement and installation records identify the customer, property, covered areas, installed system, intended use, completion date, design selections, and any expressly included substrate or moisture-related work. A product name, room name, photograph, or marketing category alone does not establish the installed system or applicable warranty. A workmanship failure is a defect caused by PrimeSlab’s preparation or installation, evaluated against the agreed work and applicable installation requirements. Normal wear is gradual deterioration from use or exposure that is not attributable to such a defect. Neither label replaces an investigation of the actual cause. Coverage begins at completion of the covered installation, as supported by reliable project records. Separate phases may have separate documented completion dates. The September 18, 2026 effective date identifies this version of the terms; it does not change an installation’s completion date or restart its coverage.
2. Five-year term, original customer, and nontransferability
Coverage begins when the qualifying commercial installation is completed and ends on its fifth anniversary. For phased work, the completion date of each covered area should be identified in project records. A covered repair does not restart the five-year period, without limiting legal rights relating to that repair. The warranty holder is the original customer named in the project agreement. That customer may be the property owner or a tenant authorized to commission the work. A tenant need not own the building to qualify under this category. The covered installation must remain at the original location. This warranty is not transferable to a different contracting customer, successor tenant, purchaser of the premises, or another site. A change in the owners or shareholders of the original customer does not by itself change the warranty holder if the same named legal entity remains the customer. A sale or assignment to a different entity does not transfer this warranty. The five-year commercial term applies even if similar products receive different residential terms.
3. Covered commercial workmanship
PrimeSlab covers failure of the specified commercial flooring caused by defective PrimeSlab preparation or installation under the agreed operating conditions. Depending on the system, this may include peeling, delamination, separation from the prepared substrate, failure between installed layers, improper cure caused by application, or defective application of an included decorative treatment. Normal business use within the agreed scope is not itself an exclusion. A heavily used area can still have a valid claim for defective adhesion or installation. PrimeSlab will evaluate the actual system, use, condition, and cause rather than assuming commercial traffic defeats coverage. This promise does not make every scrape, contaminated area, chemical event, or damaged slab a workmanship defect. It also does not excuse PrimeSlab’s failure to perform an included preparation, repair, or agreed installation requirement relevant to the loss.
4. Operating requirements and covered areas
The agreement should identify covered areas, system layers, intended foot and wheeled traffic, equipment, vehicles, load conditions, relevant chemicals, temperatures, cleaning processes, wet exposure, and any special service requirements. A showroom, salon, warehouse, kitchen, production area, and vehicle bay can require different specifications. A decorative appearance does not establish suitability for forklifts, steel wheels, heavy point loads, aggressive washdown, food-processing chemicals, or thermal shock. Unusual operating conditions should be disclosed before system selection. PrimeSlab’s agreed responsibilities for selecting and installing a system suitable for the disclosed use remain relevant. Building structure, equipment, drains, coving, vertical surfaces, waterproofing, line striping, or joint treatment is included only as identified in the scope. A later change of operations affects coverage only to the extent it causes the claimed damage; it does not automatically cancel protection for an unrelated workmanship failure.
5. Appearance, performance statements, and samples
Color, aggregate distribution, decorative movement, texture, and gloss can vary within the specified system. Lighting and surrounding surfaces can change perceived appearance. Samples and photographs should be read with the actual agreed design and performance requirements. Reasonable variation does not excuse a wrong specified product, missing layer, materially different agreed color, omitted graphic, or failure to meet an enforceable project requirement. Specialty effects, branding, and exact matching commitments should be recorded expressly instead of inferred from unrelated imagery. This warranty does not promise a permanently new appearance, universal chemical resistance, uninterrupted operations, or a universally slip-proof or sanitary surface. Any expressly agreed measurable performance requirement remains subject to its own scope; the absence of a universal guarantee is not a waiver of an actual installation promise.
6. Substrate, moisture, joints, and building conditions
Commercial slabs can move, crack, deteriorate, or transmit moisture. Coating an existing floor does not structurally rebuild the slab or guarantee that movement will never appear at a treated crack. Necessary joints and transitions must be assessed as part of the installed system and intended service. Damage from settlement, weak substrate outside the agreed repair, later leaks, floods, drainage failure, or moisture pressure outside PrimeSlab’s work is excluded to the extent of that cause. A coating is not automatically a vapor barrier, waterproofing assembly, or repair to building services. PrimeSlab’s expressly included testing, preparation, substrate repair, joint treatment, and mitigation work remain subject to evaluation. Existing-condition language does not excuse improper preparation or an included measure installed incorrectly. Where both an outside condition and covered work contribute, the findings and proposed corrective scope should identify that distinction.
7. Loads, equipment, chemicals, and changed operations
Operate within the equipment and traffic conditions specified for the system. Sharp or damaged wheels, dragged machinery, uncontrolled point loads, dropped tools, hot work, and impact can damage a correctly installed floor. Forklift turning, pallet movement, jacking, and heavy storage must match the agreed application rather than assumed universal capacity. Chemical suitability depends on the actual substance, concentration, contact time, temperature, frequency, and cleanup procedure. Steam, hot liquids, freeze-thaw exposure where relevant, and rapid temperature changes can impose conditions beyond a decorative system’s specification. An agreed chemical or thermal performance requirement must still be honored. Notify PrimeSlab before a proposed material change in use when advice about the installed system is needed. A change alone does not void the entire warranty; the connection between that change and the claimed damage must be evaluated. Cleaning records and exposure information should be reasonably related to the concern.
8. Return to service, people, and operational coordination
Follow the written schedule for foot traffic, rolling equipment, vehicles, racks, cleaning, washdown, and chemical exposure. Different operations can have different return times. Opening a space before its specified readiness can damage the system; the customer’s production schedule does not establish cure completion. Communicate restrictions to staff, tenants, cleaning contractors, delivery personnel, and other relevant users. Coordinate access control, signage, and protection of adjoining operations as appropriate to the site. PrimeSlab remains responsible for its own agreed application and return-instruction obligations. A floor texture does not eliminate all slip risk. Contaminants, water, footwear, cleaning residue, and operating practices remain relevant. This warranty does not certify an entire facility’s regulatory compliance or release responsibility for a defective installation or an agreed traction requirement.
9. Commercial cleaning, wear, and maintenance
Use the cleaners, dilution rates, temperatures, pads, brushes, and equipment appropriate to the installed system. Keep staff and cleaning contractors informed of the instructions. Remove abrasive debris, address spills and leaking machinery, and protect the installation during other construction. Ordinary wear from agreed operations can still require maintenance without being a workmanship failure. Routine cleaning, polishing, line-marking renewal, or protective-finish renewal is not automatically included for five years. There is no mandatory purchase of PrimeSlab maintenance services solely to preserve unrelated workmanship coverage. Defective PrimeSlab application remains covered even if its correction includes cleaning or recoating. Maintenance lapses affect the damage they cause rather than automatically voiding the entire warranty. Repair work can require temporary closures and cure restrictions; PrimeSlab will coordinate a plan, but this warranty does not promise zero disruption. It also does not impose a blanket waiver of every business-interruption or resulting-loss claim.
10. Exclusions and how causes are evaluated
This workmanship warranty does not cover damage to the extent caused by an excluded condition, including misuse, deliberate damage, accidental impacts, unauthorized changes that damage the work, neglected maintenance that causes the concern, or conditions outside the agreed system’s intended use. The category-specific examples above clarify those limits. An exclusion applies to the damage it causes. Evidence of moisture, a cleaning lapse, another contractor’s work, a storm, or a change in use does not automatically cancel the entire warranty. PrimeSlab will consider whether its own defective preparation or installation caused or contributed to the failure, including defective work on a repair or mitigation measure expressly included in the scope. If covered and excluded causes overlap, PrimeSlab will explain the basis for the proposed repair and any separate work. A customer is not required to buy an unrelated upgrade or maintenance service to receive a covered remedy. A condition does not become excluded merely because correcting a workmanship failure requires resealing, recoating, or replacing a protective layer.
11. Materials and separate manufacturer warranties
PrimeSlab may use suitable products from different manufacturers. Project records should identify the installed system and relevant products. This warranty does not promise that one manufacturer supplies every layer, that every product has a separate manufacturer warranty, or that all manufacturer terms are identical. A manufacturer’s product warranty, if available, has its own eligibility, exclusions, claim requirements, and remedies. PrimeSlab will provide reasonably available installed-product information relevant to a claim. No manufacturer’s warranty is extended or rewritten by this document. A material defect that is unrelated to PrimeSlab’s preparation, selection or installation responsibilities is not covered by this workmanship warranty alone. Conversely, a manufacturer’s rejection, expiration, or absence of coverage does not excuse PrimeSlab from correcting an otherwise covered workmanship failure. Application errors and failure to follow requirements applicable to PrimeSlab’s agreed work are evaluated as workmanship matters. Other rights concerning materials remain available under applicable law.
12. Covered repair and included costs
For a verified covered failure, PrimeSlab will perform the preparation and repair, recoating, or replacement of the affected installation reasonably necessary to correct that failure. The repair method must be technically appropriate to the installed system and condition. A cosmetic touch-up is not a sufficient remedy for an unresolved underlying covered failure. The labor and materials necessary for a covered repair are included at no charge throughout the applicable warranty period. Coverage is not prorated or reduced because the installation is older. This includes necessary removal of defective coating within the repair area, required surface preparation, and the replacement layers needed for that remedy. Normal initial claim review and a reasonably necessary inspection of a potentially covered workmanship concern carry no warranty inspection charge. Any proposed separate, noncovered service or special investigation with a customer charge requires a clear description, price or pricing method, and advance agreement. PrimeSlab will not make an undisclosed inspection fee a condition of considering a good-faith claim. Necessary work for an accepted covered remedy remains covered.
13. Repair boundaries, matching, and upgrades
A localized failure does not automatically entitle the customer to a new floor throughout the property, replacement of sound adjacent areas, a new design, or a more expensive system. The repair area may nevertheless need to extend beyond the visible defect to reach sound material, an appropriate joint, or a workable transition. It must be large enough to correct the covered problem. Repairs can differ in color, texture, gloss, aggregate distribution, or decorative movement because surrounding material has aged and original products or batches may no longer be available. PrimeSlab will discuss material changes and use reasonably compatible repair materials. It does not promise an invisible match, but this provision does not excuse an unsuitable repair or disregard of an expressly agreed design requirement. Optional upgrades, additional rooms, customer-requested redesign, and unrelated property improvements require a separate agreement. A customer who declines an optional upgrade still retains the covered repair. If a proposed method proves ineffective, PrimeSlab will reassess the cause and remedy; repeated unsuccessful work does not eliminate the underlying obligation or the customer’s legal rights.
14. Starting a claim and supplying information
Email info@primeslabcoatings.com or write to PrimeSlab LLC, P.O. Box 50064, Fort Myers, FL 33994. The P.O. Box is for mail, not customer visits. Describe the concern promptly after discovery so the condition can be evaluated and avoidable damage limited. Include the purchaser or contracting customer’s name, installation address, affected area, approximate completion date, when the concern was first noticed, and a description of its development. Supply photographs or video when reasonably available, together with relevant information about cleaning, spills, leaks, alterations, or changes in use. An invoice or project reference is helpful but is not the only acceptable proof of the installation. Keep available project and care records. Missing original paperwork, lack of a smartphone, or inability to identify the technical cause does not by itself invalidate an otherwise verifiable claim. PrimeSlab will use its own reasonably available records as well. No separate paid registration or annual renewal is required. This procedure does not impose a short automatic reporting forfeiture. Unreasonable delay may affect the ability to establish a cause or responsibility for avoidable additional damage; it does not automatically erase an unrelated, verifiable workmanship failure. The stated term remains relevant, and deadlines imposed by law are not extended by this informal claim process.
15. Inspection, evidence, and access
Provide reasonable access to the affected area and permit relevant non-destructive inspection. PrimeSlab may review photographs, installation records, maintenance history, site conditions, and reasonably necessary measurements. Requests for information should relate to the condition being evaluated; the customer need not prove a technical conclusion before an inspection is considered. Before destructive testing, sample removal, or opening a larger area, the parties should agree on the purpose, method, affected locations, restoration approach, and any proposed noncovered cost. PrimeSlab will not use this inspection process as permission for unrelated demolition. Reasonable coordination with a customer’s representative is permitted. Before nonemergency removal, grinding, sealing, or replacement by another contractor, give PrimeSlab a reasonable opportunity to inspect and document the original condition. If essential evidence is destroyed, coverage may be affected only to the extent a reasonable evaluation or remedy is materially prevented. A good-faith mistake or unrelated alteration does not automatically void coverage for the entire installation. PrimeSlab may pause an inspection or repair when safe access or necessary cooperation is unavailable. It will explain what is needed to resume; a temporary access problem is not, by itself, permanent cancellation of all coverage.
16. Findings, honest claims, and reconsideration
PrimeSlab will explain whether the available evidence supports coverage, what additional information is reasonably needed, and the proposed next step. A denial should identify the relevant condition, supporting findings, and applicable term. If available information is inconclusive, PrimeSlab will explain that limitation rather than represent an assumption as an established cause. Claims and supporting records must be honest. PrimeSlab may decline demands based on fabricated records, materially altered evidence, deliberate damage presented as an installation failure, or a knowingly false material account of the claimed condition, to the extent the demand depends on that conduct. A disagreement, imperfect memory, good-faith error, or unfavorable review is not fraud and is not a reason to cancel legitimate coverage. A customer may supply additional relevant evidence and request reconsideration through the warranty contact. PrimeSlab will review new information about the disputed finding. The parties may voluntarily seek an independent assessment or mediation, but this document does not impose mandatory arbitration, a fee penalty for an unsuccessful claim, or an internal decision that replaces available legal remedies.
17. Arranging repairs and preventing further damage
PrimeSlab and the customer will coordinate a reasonable repair plan, access, preparation of the work area, and return-to-use instructions. Weather, site moisture, product availability, safe working conditions, and curing requirements can affect scheduling. PrimeSlab will communicate material scheduling changes; these factors do not provide an unlimited right to leave an accepted claim unresolved. The customer should secure people, pets, movable belongings, and normal access to the affected area as reasonably agreed. Major removals, disconnects, specialist moving, or unrelated site corrections must be discussed before work. This document does not impose undisclosed charges or make a blanket allocation of every incidental cost to the customer. Take reasonable steps to prevent avoidable additional damage, without undertaking unsafe work. Restrict hazardous use where practical and address active leaks or other continuing outside causes. PrimeSlab may require an identified cause outside its work to be corrected before a durable repair can proceed, but it must explain the connection. Covered PrimeSlab work cannot be shifted to the customer by describing it as a prerequisite.
18. Emergency work, other contractors, and duplicate recovery
Necessary emergency measures to protect people or property may proceed without waiting for PrimeSlab. Notify PrimeSlab as soon as reasonably practical and preserve photographs, removed samples when safe, receipts, and other available evidence. Failure to obtain advance approval during a genuine emergency does not automatically defeat a valid claim. For nonemergency work for which the customer seeks payment from PrimeSlab, obtain written agreement on the scope and price before engaging another contractor where reasonably practical. PrimeSlab is not automatically responsible for an unapproved upgrade or an unnecessarily extensive third-party replacement. This provision does not override rights available when PrimeSlab fails to provide a required remedy or where applicable law provides otherwise. Using another qualified provider for routine care or unrelated work does not itself terminate this warranty. Damage caused by that provider is evaluated according to its cause. PrimeSlab will not require purchase of its own paid maintenance services solely to keep workmanship coverage. The customer should disclose repair payments or work already received for the same loss when relevant to the requested remedy. This warranty does not promise duplicate payment for the same repair, and it does not expand PrimeSlab’s rights against an insurer or reduce a customer’s independent legal rights.
19. Project changes, payments, and the issued version
Document changes to the agreed work, use, design, or system before the change is performed. A later paid installation can have its own scope, completion date, and written warranty; it does not automatically restart coverage for the original work. An ordinary covered repair remains subject to the original term and holder conditions, without limiting rights that may apply to the repair itself. The warranty version provided with the project agreement applies to that installation. Later website edits do not reduce previously issued coverage. The effective date shown on this page is not a retroactive change to existing customer rights. Payment and collection obligations are addressed by the project agreement and applicable law. This warranty does not add an automatic cancellation for a disputed balance, require waiver of a legitimate claim to resolve an invoice, or make purchase of additional services a renewal condition. Nor does filing a claim by itself cancel otherwise valid payment obligations. The project scope identifies the work promised. General exclusions do not excuse failure to perform an expressly agreed preparation, mitigation, or installation obligation. A signature acknowledging receipt of care instructions or completion does not, by itself, release an undisclosed defect or statutory right.
20. Legal rights and relationship to other obligations
This limited warranty describes the workmanship coverage voluntarily offered for the identified installation. It does not make every possible loss a covered warranty repair, and it does not disclaim liability or remedies that cannot lawfully be excluded. No general waiver of implied warranties, personal-injury claims, mandatory rights, or every form of resulting loss is created by this document. This warranty gives you specific legal rights, and you may also have other rights that vary by state. Applicable rights concerning defective work, materials, misrepresentations, or repairs are preserved. If a provision cannot lawfully be applied, it is limited to its lawful effect without erasing the remaining valid coverage. An informal email or warranty review does not necessarily satisfy a formal legal notice requirement or pause a legal deadline. Any legally applicable construction-defect notice and opportunity-to-repair procedure remains separate; this document does not impose one indiscriminately on every customer. The stated warranty duration and a legal time limit for bringing a claim are different matters. PrimeSlab will provide these terms for review in connection with the project agreement. This document does not silently withdraw an enforceable project-specific promise, and the customer’s receipt of it does not create an agreement to additional dispute restrictions that are not stated here.
